TERMS AND CONDITIONS
CYGNUS SAGLIK HIZMETLERI LIMITED SIRKETI
These Terms and Conditions set out the terms and conditions applicable to any treatment package purchased from CYGNUS SAGLIK HIZMETLERI LIMITED SIRKETI (“Cygnus Clinic”).
Please read these Terms and Conditions and the documents referred to below carefully.
Accessing the information and services provided on the website https://www.cygnusclinics.com constitutes acceptance of these Terms and Conditions.
By completing your booking with Cygnus Clinic, you confirm that you are bound by and agree to comply with these Terms and Conditions. Cygnus Clinic reserves the right to amend or update these Terms and Conditions at any time without prior notice.
When you share your medical history, confirm your suitability for the planned operation, and approve the provided quotation, you will be required to pay a deposit to confirm the surgery date and fee in accordance with these Terms and Conditions.
DEFINITIONS
Cygnus Clinic
CYGNUS SAGLIK HIZMETLERI LIMITED SIRKETI, a medical tourism facilitator incorporated at Sahrayıcedit Mah. Atatürk Cad. No:69 D:46 Kadıköy İstanbul under license number 2161235755.
Healthcare Provider
The hospital, private clinic, surgeon, anesthesiologist, or any other medical professional providing consultation, examination, treatment, and aftercare.
Treatment Package
The package selected by the patient, which may include treatment, accommodation, transfers, and customer experience services depending on the patient’s choice.
Treatment
The medical treatment or procedure to be performed by the chosen Healthcare Provider.
CYGNUS CLINIC’S LIABILITIES AND RESPONSIBILITIES
- The treatment package is prepared based on photographs, medical information, and test results provided by the patient and may be revised following physical examination by the Healthcare Provider.
- The treatment package includes standard pre-operative examinations. Additional tests or examinations required due to pre-existing conditions or clinical findings may incur additional charges.
- The treatment package includes the assessed number of hospital nights stated in the quotation and/or itinerary. Any additional nights beyond those stated will be charged to the patient at the hospital’s current rates.
- Cygnus Clinic acts solely as a medical facilitator and does not operate or control any Healthcare Provider. By accepting these Terms and Conditions, you agree not to hold Cygnus Clinic responsible or liable for malpractice, complications, dissatisfaction, or outcomes arising from treatment provided by the Healthcare Provider.
The consent forms and agreements signed at the treatment facility constitute a direct contractual relationship between you and the Healthcare Provider.
Cygnus Clinic does not hold medical qualifications and shall not be responsible or liable for any medical procedures, advice, or outcomes provided by the Healthcare Provider.
Cygnus Clinic shall not be responsible or liable for any care, treatment, or services provided by the Healthcare Provider, or for any malpractice claims arising directly or indirectly from such services.
- Prior to your journey, Cygnus Clinic will provide information including, where applicable, the Healthcare Provider details, hotel details, customer experience specialist details, transfer arrangements, treatment date and time, treatment package cost, and visa and passport requirements.
- Cygnus Clinic arranges accommodation, transfers, and hospital bookings but bears no legal responsibility for the provision or performance of third-party services.
YOUR RESPONSIBILITIES
- By accepting these Terms and Conditions, you agree to disclose complete and accurate information regarding your medical condition.
- You are responsible for providing correct and complete medical information in order to receive an appropriate treatment plan.
- You are responsible for arranging travel documents, including passport and visa. Cygnus Clinic is not responsible for arranging travel to Turkey.
- By accepting these Terms and Conditions, you authorise Cygnus Clinic to obtain and retain your medical records where necessary.
- To receive treatment, you must pay a deposit prior to travel and complete full payment prior to treatment. No treatment will be provided before full payment is completed.
- Travel and medical insurance valid during your stay are your responsibility and are not included in the treatment package.
DEPOSIT, CANCELLATION, AND MEDICAL CLEARANCE POLICY
Deposit and Booking Confirmation
A deposit is required to confirm a surgical booking.
The deposit confirms and locks in the quoted procedure(s) and agreed price, secures hospital, surgeon, anesthesiology, and operating room availability, and covers advance administrative, medical coordination, and scheduling costs.
For these reasons, all deposits are non-refundable, except where expressly required by applicable law.
Patient-Initiated Cancellation or Postponement
If the patient cancels or postpones the treatment for personal reasons, the patient may be responsible for costs already incurred.
These costs may include, but are not limited to, hotel accommodation, hospital admission room, operating or surgery room, transportation, and logistical services.
Such charges represent third-party provider costs and are not penalties imposed by Cygnus Clinic. Final amounts depend on confirmed bookings and the timing of cancellation.
Medical Examination, Clearance, and Medical Ineligibility
All treatments are subject to final medical and anesthetic clearance, which may occur before arrival, upon arrival, or on the day of surgery.
Treatment may be cancelled or postponed if, in the medical judgment of the surgeon or anesthesiologist, the patient’s medical history was incomplete or inaccurate, pre-operative test results indicate increased risk, previous surgeries or relevant conditions were not disclosed, or proceeding with treatment is deemed unsafe or clinically inappropriate.
In such cases, the deposit remains non-refundable, pre-booked hospital, operating room, accommodation, or logistics costs may still apply, and surgical fees may be partially or fully waived at Cygnus Clinic’s discretion, particularly if the patient reschedules.
All medical decisions are made solely in the interest of patient safety and cannot be overridden.
Patient Disclosure Responsibility
The patient confirms that all medical history, medications, supplements, prior surgeries, and relevant health conditions have been disclosed truthfully and completely. Failure to disclose accurate information may result in cancellation, forfeiture of the deposit, and liability for applicable third-party costs.
Rescheduling
If the patient elects to reschedule rather than cancel, Cygnus Clinic will make reasonable efforts to minimise additional charges where possible. Rescheduling is subject to availability, third-party provider policies, and notice period.
No-Profit on Cancellations
Cygnus Clinic does not profit from cancellations or postponements. Any charges applied reflect actual costs incurred in securing services on behalf of the patient.
AFTERCARE
You will receive post-operative controls, including at least one at the hospital and one prior to returning to your country. Aftercare instructions will be provided by your surgeon.
You are obliged to follow all aftercare instructions. If complications occur after returning home, Cygnus Clinic will assist by coordinating communication with your surgeon based on information you provide.
If revision or corrective treatment is required and accepted by the surgeon, the surgeon will underwrite the cost of the treatment. The patient will bear the cost of hospital, travel, accommodation, transfers, and sustenance.
Cygnus Clinic is not responsible for refunding transfer, hospital, or surgeon expenses and strongly recommends valid medical travel insurance.
FEEDBACKS AND REVIEWS
Cygnus Clinic aims to provide excellent service and welcomes sincere and genuine feedback related directly to Cygnus Clinic services.
By accepting these Terms and Conditions, you agree not to publicly attack or defame Cygnus Clinic or its third-party service providers. In the event of violation, Cygnus Clinic may request removal of content and pursue legal remedies as permitted by law.
CONFIDENTIALITY AND DATA PROTECTION
Cygnus Clinic is responsible for safeguarding personal information in accordance with Turkish data protection laws. Personal data will only be shared with medical staff where necessary.
By accepting these Terms and Conditions, you consent to the anonymous use of before-and-after images for demonstrative purposes.
JURISDICTION
Any disputes arising from these Terms and Conditions shall be subject to the jurisdiction of the Courts and Execution Directorates of Istanbul, Turkey.
